These Terms of Service ("Terms") govern your access to and use of the SMASS website at saasmyass.ai and all related services (collectively, the "Service"). SMASS offers the following subscription plans, billed monthly:
All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.
Free trials: If we offer a free trial, you will not be charged until the trial period ends. You may cancel at any time before the trial expires to avoid being charged.
Cancellation: You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing cycle. You will retain access to paid features until the end of the period you have already paid for.
Refunds: Payments are generally non-refundable. However, if you believe you have been charged in error, please contact us at billy@saasmyass.ai within 14 days of the charge, and we will review your request on a case-by-case basis.
You agree not to use the Service to:
The Service, including its design, code, features, branding, and documentation, is owned by SMASS and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.
Your content: You retain ownership of any content you submit to the Service (e.g., website URLs, brand information). By submitting content, you grant us a limited, non-exclusive license to process and use that content solely to provide the Service to you.
Generated output: Ad copy, creative assets, and other materials generated by the Service using your inputs are yours to use for your business purposes, subject to these Terms. We do not claim ownership of generated output.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMASS AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including, without limitation, intellectual property, limitation of liability, and indemnification) shall survive.
You may terminate your account at any time by canceling your subscription and contacting us at billy@saasmyass.ai to request account deletion.
You agree to indemnify, defend, and hold harmless SMASS and its operator, Billy Cribbs, from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or your violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
We reserve the right to update or modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Service and updating the "Effective Date" above. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
